Effective date: July 2, 2019 Welcome to Dote. Please read on to learn the rules and restrictions that govern your use of our website(s), products, services and applications (the “Services”). These Terms of Use (the “Terms”) are a binding contract between you and Dote, Inc. (“Dote,” “we” and “us”). You must agree to and accept all of the Terms, or you don’t have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in the Privacy Policy, and the Company’s Community Guidelines. Will these Terms ever change? We are constantly trying to improve our Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the website, by sending you an email, and/or by some other means. If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes. Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us. What about my privacy? Dote takes the privacy of its users very seriously. For the current Dote Privacy Policy, please click here. Dote uses third party services to collect information regarding users’ activities while users are using our Services in order to track, understand, and improve the user experiences with our Services, but we’ll not provide any personally identifiable information with such third party service providers without your consent. Please refer to our Privacy Policy for more information. The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at What are the basics of using Dote? You can browse our website and download our application (“Dote App”) from the Apple App Store or the Google Play App Store and browse the contents in the Dote App. But you are required to sign up for an account, and select a user name (“Dote User ID”) in order to shop on our Services. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your Dote User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission. You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and gotten your parent or guardian to agree to these Terms on your behalf). You will not share your account with anyone, and you must protect the security of your account. You’re responsible for any activity associated with your account. Furthermore, to keep your account active, be sure to log in at least every 2 months. An account may be permanently removed, and we may reclaim the Dote User ID without notice, due to prolonged inactivity. Your use of the Services is subject to the following additional restrictions: You represent, warrant, and agree that you will not contribute any Content or User Submission (each of those terms is defined below) or otherwise use the Services or interact with the Services in a manner that: Infringes or violates the intellectual property rights or any other rights of anyone else (including Dote); Violates any law or regulation, including any applicable export control laws; Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable; Jeopardizes the security of your Dote account or anyone else’s (such as allowing someone else to log in to the Services as you); Attempts, in any manner, to obtain the password, account, or other security information from any other user; Violates the security of any computer network, or cracks any passwords or security encryption codes; Runs Maillist, Listserv, any form of auto-responder or “spam”, on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure); “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means); Copies or stores any significant portion of the Content; Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services; Accesses, uses, or otherwise exploits the Services in violation of any applicable agreements, guidelines, regulations, or policies that Dote makes available on the Services or otherwise in any manner deemed objectionable by Dote in its sole discretion. You further agree that you will not submit to the Service any Content or User Submission that is contrary to the Dote Community Guidelines, currently found at, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations. In the event of a conflict or inconsistency between these terms and the Community Guidelines, these Terms shall control and govern the rights and obligations of the parties. A violation of any of the foregoing is grounds for termination of your right to use or access the Services. What are my rights in Dote? The materials displayed or performed or available on or through the Services, including, but not limited to, marks, logos, brand names, text, graphics, data, articles, photos, images, illustrations, User Submissions, and so forth (all of the foregoing, the “Content”) are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you, (i) without the prior consent of the owner of that Content or (ii) in a way that violates someone else’s (including Dote’s) rights. You understand that Dote owns the Services. You won’t modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, or otherwise exploit any of the Services. The Services may allow you to copy or download certain Content; please remember that just because this functionality exists, doesn’t mean that all the restrictions above don’t apply – they do! Do I have to grant any licenses to Dote or to other users? User Submission means (1) any information, content, data or anything else that you post upload, share, store, or otherwise provide to your Dote account or otherwise on or through the Services, including any such information, content or data that is not viewable by any other user except you; and (2) any feedback, suggestions, improvements, enhancements, and/or feature requests relating to the Services you provide us (in a direct email or otherwise). For all User Submissions, you hereby grant Dote a license to perform, display, distribute, translate, modify (for technical purposes, for example making sure your content is viewable on an iPhone as well as a computer), create derivative works of, reproduce, act with respect to, use and otherwise fully exploit your User Submissions, to enable us to operate the Services, or otherwise in connection with Dote’s business, provided that our use of any User Submission that constitutes Personal Information shall be treated in accordance with our Privacy Policy. This is a license only – your ownership in User Submissions is not affected. You agree that the licenses you grant are royalty-free, perpetual, sublicenseable, irrevocable, and worldwide. Who is responsible for what I see and do on the Services? We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services. You are responsible for all Content you contribute, in any manner, to the Services, and you represent and warrant you have all rights necessary to do so, in the manner in which you contribute it. You will keep all your registration information accurate and current. You are responsible for all your activity in connection with the Services. The Services may contain links or connections to third party websites or services that are not owned or controlled by Dote. When you access third party websites or use third party services, you accept that there are risks in doing so, and that Dote is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third party website or service that you visit or utilize. Dote acts as an intermediary for users to interact with retailers available on the Services to buy and sell items offered by such retailers on the Services, and does not act as the buyer or seller (or agent for buyers or sellers) with respect to any such transactions. Dote has no control over, does not endorse or guarantee, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, Dote will not and cannot monitor, verify, censor or edit the content of any third party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third party website or service. Your orders placed on the Services will be directly with the retailer offering the products. Your card is authorized when you place the order (before the retailer confirms the order) and is charged when the order is shipped from the retailer. You will see “Dote Shopping” as the merchant on your credit card bills. We’ll assist in the delivery of goods and refund processing, but your other interactions with the retailers, including pricing, or return of goods or services, return or refund policies, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such retailers. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties retailers. You agree that Dote shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. However, we always endeavor to provide our assistance to you to solve any issues you may encounter in the dealings with the retailers. Please refer to our FAQ webpage (“FAQ”) for additional information that applies to purchases made through the Services. If there is a dispute between you and a retailer shopped from on this site, or between you and any third party, you agree that Dote is under no obligation to become involved. In the event that you have a dispute with one or more other retailers or third parties, you release Dote, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her must have materially affected his or her settlement with the debtor." What do I need to know about Dote’s Rewards Program? Dote uses credit, coins or the like (each, a “Reward”) to reward users for using, supporting, and recommending our business (the “Rewards Program”). The Rewards Program is open to legal residents of the fifty (50) United States and the District of Columbia. By participating in the Rewards Program, you agree to abide by these Terms. Dote may, but has no obligation to, grant you any Rewards. Rewards may only be valid for a limited period of time, so please take note of any applicable expiration dates, and use your Rewards in a timely manner. Rewards may not be purchased. Please refer to the Dote App or our FAQ for more details about any specific Reward. From time to time, Dote may offer different types of Rewards, including: Credit: “Credits” include courtesy credits, promotional credit, and referral credits granted by Dote at its sole discretion. If no expiration date is provided, Credits expire 3 months after the date they are posted to your account. You can earn a maximum of $75 of referral Credits. Credits are not cash or a cash equivalent, have no cash value, and are not redeemable for cash or cash equivalents. Coins: “Coins” are reward points that you can earn and may be used to redeem Prizes (as define below) or cash. Generally, Coins are automatically added to your Dote account within 3 business days of when you earned them. Coins accrued in your Dote account will expire after three (3) months of no activities in your account. This means you must redeem any accrued Coins before such expiration, or log in to your account on the Dote App at least once every three (3) months to keep the accrued Coins from expiring. You may earn “Coins” by doing the following (each, an “Activity”), in each case subject to any additional terms and conditions as set forth in the Dote App or our FAQ and so long as Dote is able to properly track your valid and completed Coin-earning Activities: When you make a purchase in the Dote App; When another user makes a purchase by clicking on a tagged item in your User Submission; or By participating in certain activities, promotions or games offered by Dote. The number of Coin you may earn for an Activity will be as specified in the Dote App or in our FAQ. Dote reserves the right to modify the amount you may earn at any time in its sole discretion. Dote may suspend or terminate an Activity, or a user’s ability to participate in it, at any time for any reason. Dote reserves the right to review and investigate all account activities and to suspend accounts or modify, adjust or remove Coins awarded in its sole discretion as deemed fair and appropriate. If you do not receive a Reward within the indicated time frame, you must contact us within sixty (60) days from the date you were granted or earned such Reward. After sixty (60) days, if we have not heard from you and our records indicate that the Reward was fulfilled, you will be deemed to have received the Reward and it will not be replaced, even if it is reported missing. The Rewards held in your Dote account are personal to you and may not be sold, transferred, bartered or assigned to, or shared with, family, friends or any other person, or used by you for any commercial purpose. Rewards are not your property and cannot be bought, sold or transferred in any way (including death or as part of a domestic matter). Dote is not responsible for disputes involving unauthorized users relating to use of Rewards. In the event that your Dote account is unregistered, terminated or rendered inactive, all accrued Rewards, including any Coins, in your Dote account will be forfeited. Dote reserves the right to change, modify and/or eliminate any Reward or the Rewards Program and the terms applicable thereto at any time and in its sole discretion, without notice to you. You are responsible for regularly checking this App for updates and notices of changes. Dote reserves the right to terminate your participation in the Rewards Program if Dote determines in its sole discretion that you have violated these terms or that the use of your Dote account is unauthorized, deceptive, fraudulent or otherwise unlawful. Determination of any tax liability relating to the Rewards and payment of any taxes that may be due on them are solely your responsibility. All questions or disputes regarding the Rewards, including on eligibility and matters involving Credits or Coins, will be resolved by Dote in its sole discretion. What are the terms for redeeming my Coins? The Coins you earn are redeemable for prizes (each, a “Prize”), solely through the Dote App and in accordance with the terms specified for such Prize in the Dote App at the time of redemption. A full listing of current Prizes and redemption options are available in the Dote App. The Prizes available to you will be based on the number of Coins that you have accrued. If you redeem Coins as a store credit, it can only be applied to a subsequent purchase. If you have accumulated at least 30,000 Coins, you may request to redeem a minimum of 30,000 Coins for cash in the Dote App (a “Cash Redemption”). The applicable Coin-to-cash exchange rate will be as specified in the Dote App or in the FAQ at time of the Cash Redemption. Dote may change the exchange rate for Coins at any time without prior notice. Once you initiate a Cash Redemption, you will be requested to provide the necessary information to transfer the cash amount to you. Cash transfers will payable in U.S. dollars and made solely via PayPal. You must have a PayPal account in order to receive such transfer; otherwise, Dote is not required to make any transfer or payment to you. You are solely responsible for any costs or fees incurred related to such cash transfer, including any PayPal fees. You must be a legal residents of the fifty (50) United States and the District of Columbia in order to be eligible for any redemption. No credit, reversal, return or refund of Coins will be issued for any reason after Coins have been redeemed. Coin redemption rules and Prizes may vary, and are subject to change at Dote’s sole discretion. Dote and its affiliates and agents are not responsible for any Prize that are products or services of other companies and partners. Determination of any tax liability relating to the Coin redemptions for Prizes or cash and payment of any taxes that may be due on them are solely your responsibility. By redeeming your Coins, you agree to indemnify, defend and hold Dote harmless from any liability for, or assessment of, any claims or penalties with respect to any liability for, or assessment of, withholding taxes imposed on the Company by the relevant taxing authorities with respect to such redemption. All questions or disputes regarding Coin redemptions will be resolved by Dote in its sole discretion. What Communication will there be with Dote? You verify that any contact information provided to Dote, including, but not limited to, your e-mail address and mobile phone number is true and accurate. You further verify that you are the telephone subscriber and/or that you own any telephone numbers that you provide to Dote. You acknowledge that by voluntarily providing your telephone numbers to Dote, you expressly agree to be contacted at the telephone numbers you provide. You consent to receive e-mails, pre-recorded voice messages and/or autodialed calls (including text messages) by or on behalf of Dote relating to this Agreement, any transaction with Dote, matters related to your account, and promotions from Dote. These communications may be made by or on behalf of Dote, even if your phone number is registered on any state or federal Do Not Call list. You acknowledge that you may incur a charge for these texts or calls by your telephone carrier and that Dote will not be responsible for these charges. Will Dote ever change the Services? We’re always trying to improve the Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We’ll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn’t always practical. Similarly, we reserve the right to remove any Content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice. Does Dote cost anything? Your access and use of the Services are currently free, but if you choose to purchase goods or services through the Services, you will be charged the listed price for such good or service, to the credit card or other payment method you provide in your Dote account (including, e.g. PayPal, Visa, Mastercard). Depending on the availability of the products, Dote may limit or cancel quantities of product purchased, and it reserves the right to refuse or cancel any order in its discretion. In the event Dote needs to make a change to an order, it will attempt to notify you by contacting the email address, billing address, and/or phone number provided in your Dote account or at the time the order was made. The prices displayed on our Services are quoted in U.S. currency. Prices are subject to change at any time. Sales tax will be determined by Dote and automatically be added to the order. If you provide inaccurate or incomplete credit card information, we may not be able to complete your transaction, and your purchase may be cancelled or delayed. We reserve the right to charge for certain or all Services in the future. We will notify you before any Services you are then using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees for such Services Please refer to our FAQ for additional information that applies to purchases made through the Services. Do I have to grant any licenses to Dote or to other users? As a Dote account holder you may submit certain “User Submissions” to the Services. “User Submissions” shall include, but are not limited to (1) any information, videos, comments, content, data or anything else that you post upload, share, store, or otherwise provide to your Dote account or otherwise on or through the Services, including any such information, content or data that is not viewable by any other user except you; and (2) any feedback, suggestions, improvements, enhancements, and/or feature requests relating to the Services you provide us (in a direct email or otherwise). You understand that Dote does not guarantee any confidentiality with respect to any of the User Submissions you submit. You shall be solely responsible for your own User Submissions and the consequences of submitting and publishing your User Submissions on the Services. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Submissions you submit; and you license to Dote all patent, trademark, trade secret, copyright or other proprietary rights in and to such User Submissions for publication on the Services pursuant to these Terms. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to Dote, you hereby grant Dote a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Services and Dote's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Services a non-exclusive license to access your User Submissions through the Services, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Services and under these Terms. The above licenses granted by you in video User Submissions you submit to the Services terminate within a commercially reasonable time after you remove or delete your videos from the Services. You understand and agree, however, that Dote may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable. You further agree that User Submissions you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant Dote all of the license rights granted herein. You further agree that you will not submit to the Services any User Submissions or other material that is contrary to the these Terms, or contrary to applicable local, national, and international laws and regulations. Dote does not endorse any User Submissions submitted to the Services by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Dote expressly disclaims any and all liability in connection with User Submissions. Dote does not permit copyright infringing activities and infringement of intellectual property rights on the Services, and Dote will remove all User Submissions if properly notified that such User Submission infringes on another's intellectual property rights. Dote reserves the right to remove User Submissions without prior notice. What if my intellectual property rights are being infringed upon? If you believe that any of your User Submissions have been copied in a manner that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, you can request that we take down the infringing material by filing a Digital Millennium Copyright Act (“DMCA”) Notice (“Notice”) with Dote. Your Notice must include the following requirements: Identification of the copyrighted work claimed to have been infringed, or, in the case of multiple copyrighted works, a representative list of such works; Identification of the content on Dote that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Dote to locate the material (e.g., url address, etc.); Information reasonably sufficient to permit Dote to contact you, such as physical address, an email address, and telephone number; A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and Your full legal name and your physical or electronic signature. When we receive a clear and valid Notice pursuant to the guidelines set forth below, we will respond by either taking down the allegedly infringing material or blocking access to it. We may contact the Notice provider to request additional information. We reserve the right to ignore a Notice that is not in compliance with the DMCA. You may direct your Notice to our DMCA agent at 515 Alabama St, San Francisco, CA 94110 or by email at You acknowledge that if you fail to comply with all of the Notice requirements, your DMCA notice may not be valid. What if I want to stop using my Dote account? You’re free to cancel your Dote account at any time, by contacting us at; please refer to our Privacy Policy as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services. You understand and agree that you will not be able to access your accumulated Points after you cancel your Dote account. All of the foregoing is subject to the restrictions and limitations set forth herein with respect to the Dote Credit Program. Dote is also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms or other acts that deemed objectionable by Dote in its sole discretion. Dote has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms. Account termination may result in destruction of any Content associated with your account, including any accumulated Points, and it may not be possible to reinstate your Dote account once it is terminated, so keep that in mind before you decide to terminate your account. If you have deleted your account by mistake, contact us immediately at– we will try to help, but unfortunately, we can’t promise that we can recover or restore anything. Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us. I use the Dote App available via the Apple App Store – should I know anything about that? These Terms apply to your use of all the Services, including the iPhone, iPad Touch, and iPad applications available via the Apple, Inc. (“Apple”) App Store or the Google LLC (“Google Play”) App Store (the “Application”), but the following additional terms also apply to the Application: Both you and Dote acknowledge that the Terms are concluded between you and Dote only, and not with Apple, and that Apple is not responsible for the Application or the Content; The Application is licensed to you on a limited, non-exclusive, non-transferrable, non-sublicensable basis, solely to be used in connection with the Services for your private, personal, non-commercial use, subject to all the terms and conditions of these Terms as they are applicable to the Services; You will only use the Application in connection with an Apple device that you own or control; You acknowledge and agree that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application; In the event of any failure of the Application to conform to any applicable warranty, including those implied by law, you may notify Apple of such failure; upon notification, Apple’s sole warranty obligation to you will be to refund to you the purchase price, if any, of the Application; You acknowledge and agree that Dote, and not Apple, is responsible for addressing any claims you or any third party may have in relation to the Application; You acknowledge and agree that, in the event of any third party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Dote, and not Apple, will be responsible for the investigation, defense, settlement and discharge of any such infringement claim; You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties; Both you and Dote acknowledge and agree that, in your use of the Application, you will comply with any applicable third party terms of agreement which may affect or be affected by such use; and Both you and Dote acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as the third party beneficiary hereof. What else do I need to know? Warranty Disclaimer. Neither Dote nor its licensors or suppliers makes any representations or warranties concerning any content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through the Services. Products and services purchased or offered (whether or not following such recommendations and suggestions) through the Services are provided “AS IS” and without any warranty of any kind from Dote or others (unless, with respect to such others only, provided expressly and unambiguously in writing by a designated third party for a specific product). We may transfer, assign, or delegate these Terms and our rights and obligations without consent. Choice of Law; Arbitration. These Terms are governed by and will be construed under the laws of the State of California, without regard to the conflicts of laws provisions thereof. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in San Francisco County, California, in English, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. Dote is making efforts to maintain and increase the accessibility of its Services (including its mobile application) to ensure that persons with disabilities have fully and equal enjoyment of Dote’s electronic goods, services, facilities, privileges, advantages and accommodations. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that the Dote may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and Dote agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Dote, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Dote, and you do not have any authority of any kind to bind Dote in any respect whatsoever. In connection with the Services, Dote partners with many retail brands (“Brand Partners”). In order for an entry to be considered eligible, you must have your full name and email on your profile in the Dote App. By submitting an entry, you agree that any information provided by you or collected by Sponsor in connection with a Sweepstakes may be used by Sponsor in accordance with Sponsor's Privacy Policy ( and may be shared with Sponsor's affiliated business entities. All information submitted to Sponsor as part of an entry becomes the property of the Sponsor.

Persons discovered entering under several names or email addresses will be disqualified. Sponsor reserves the right to disqualify false entries or entries suspected of being false. Entries generated by a script, macro or other automated means will be disqualified. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.

Alternative Method of Entry ("AMOE")

You may also enter any Sweepstakes by mail as follows. On a plain 3" x 5" index card, legibly handprint or type your first name, last name, date of birth, complete address, city, state, zip code, home phone number (including area code), and email address (if any) and mail your completed 3" x 5" card to Dote: 515 Alabama St, San Francisco, CA 94110. To be considered eligible in a Sweepstakes, AMOE entries must be postmarked no later than the last day of the Entry Period. Each AMOE card received will be considered as one (1) entry for that entrant.

Regardless of the method used to enter a Sweepstakes, the maximum number of entries allowed during the Entry Period is one (1) per entrant. Non-winning entries in one Sweepstakes will not be carried over into any other Sweepstakes. Sponsor is not responsible for entries that we do not receive for any reason, or for entries that we receive but are not decipherable for any reason.


One winner (the “Winner”) will be selected in accordance with these Rules to receive the prize(s) as set forth on the applicable Sweepstakes Page. Total Approximate Retail Value (“ARV”) of the prizes are as stated on the Sweepstakes Page (up to a maximum value of $500).

Eligibility, age, and any and all other claims shall be subject to verification prior to the actual awarding of a prize. All details regarding redemption of a prize are at Sponsor’ sole discretion and will be provided at the time of notification.

The Winner is solely responsible for any other unspecified expenses related to the prize, including without limitation and any and all federal, state, and local taxes on prize. The Winner is not entitled to any surplus between actual retail value of a prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded.

In no event shall the Sponsor be obligated to award any prizes other than the prizes specified on the applicable Sweepstakes Page. The prizes are non-transferable and no substitutions (including, without limitation, for cash) are permitted, except that Sponsor reserves the right to substitute a prize of equal or greater monetary value for any advertised prize if such prize should become unavailable for any reason. If the Winner is unable to accept the prize or any portion of the prize for any reason, Sponsor shall have no further obligation to the Winner.

Each prize is a taxable event. The Winner shall be responsible and liable for all federal, state and local taxes on the value of the prizes, and any related shipping and handling charges. The Winner may be issued an IRS Form 1099 for the ARV of any awarded prize.

Please allow 6-8 weeks for delivery of the prizes. The prizes shall only be delivered to an address in the United States. Sponsor shall be solely responsible for prize fulfillment.


Odds of winning are based on the number of entries received during the Entry Period.

Winner Selection

Within 7 days following the end of a Sweepstake’s Entry Period, the Winner for the prize will be chosen at random from all eligible entries during the Entry Period. In the event of a dispute regarding the identity of the Winner, the Winner will be deemed to be the person in whose name the Dote account is registered.

The Winner will be notified by push notification and alert in the Dote App or by SMS if the Winner has opted in for SMS notifications (the “Prize Notification”); provided, however, that Sponsor reserves the right to determine an alternate method of notification. The Winner must claim the applicable prize within 21 days after the Prize Notification by selecting the size and color, as applicable, of each prize item, providing the required information and tapping the “Redeem” button in the Dote App. The Winner’s failure to complete the redemption process within the specified 21-day period will be considered such Sweepstakes Winner's forfeiture of the prize and the applicable prize will remain unawarded. Sponsor may not make multiple attempts to contact the Winner.

When applicable, the Winner may be required to execute and return (and winning may be conditioned upon the Winner executing and returning) to Sponsor, within ten (10) business days, an Affidavit of Eligibility and a Liability and Publicity Release (the “Release”) drafted by Sponsor to be eligible for the prize. The Winner may be required in Sponsor's sole discretion to complete relevant tax forms as a condition to the delivery of the applicable prize. The Winner may also be required to furnish proof of identity, address, U.S. Social Security Number (for tax form purposes) and birth date in order to receive a prize.

Unless prohibited by applicable law, your acceptance of a prize constitutes your permission to use your name, photograph, likeness, voice, address (city and state) and testimonials on a worldwide basis, and in all forms of media, in perpetuity, in any manner Sponsor deems appropriate for publicity purposes, without review, approval, notifications, permissions or further compensation; and constitutes your consent to disclose your personally identifiable information to third parties (including, without limitation, placing the Winner's name on a winners list).

A prize will be forfeited and remain unawarded if the Winner: (i) cannot be reached; (ii) does not respond to the Prize Notification in a timely manner as required pursuant to these Official Rules; (iii) fails to complete the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iv) cannot accept or receive a prize for any reason. By entering a Sweepstakes, you agree to and hereby do release and hold harmless Sponsor, any other entity(ies) associated with a prize, and their respective parents, subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, "Claims") that may arise from your acceptance, possession and/or use of any prize or your participation in the applicable Sweepstakes, or from any misuse or malfunction of any prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. Caution: any attempt to deliberately damage or undermine the legitimate operation of a sweepstakes may be in violation of criminal and civil laws and will result in disqualification from participation in the Sweepstakes. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.

Sponsor reserves the right to modify these Official Rules in any way or at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend a Sweepstakes should viruses, bugs or other causes beyond their control corrupt the administration, security or proper operation of such Sweepstakes. In the event of cancellation or suspension, Sponsor shall promptly post a notice on Sponsor's website to such effect.


Each Sweepstakes shall be governed by the state law of California, without regard to conflicts of laws provisions. By participating in a Sweepstakes, you agree that any dispute or litigation arising from or relating to such Sweepstakes shall be determined by binding arbitration only in San Francisco, California, by and under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, Sponsor may seek equitable relief in any court of competent jurisdiction. If any provision of these rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these rules otherwise remain in full force and effect and enforceable.


All personal information collected by Sponsor will be used for administration of the Sweepstakes. In addition, Entrants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s Privacy Policy. Please refer to Sponsor’s Privacy Policy for important information regarding the collection, use and disclosure of personal information by Sponsor.
