Welcome to Dote. Please read on to learn the rules and restrictions that govern your use of our website(s), products, services and applications (the “Services”). These Terms of Use (the “Terms”) are a binding contract between you and Dote, Inc. (“Dote,” “we” and “us”). You must agree to and accept all of the Terms, or you don’t have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in the Privacy Policy.

Will these Terms ever change?

We are constantly trying to improve our Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the www.doteshopping.com website, by sending you an email, and/or by some other means.

If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us.

What about my privacy?

Dote takes the privacy of its users very seriously. For the current Dote Privacy Policy, please click here. Dote uses third party services to collect information regarding users’ activities while users are using our Services in order to track, understand, and improve the user experiences with our Services, but we’ll not provide any personally identifiable information with such third party service providers without your consent. Please refer to our Privacy Policy for more information.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at [email protected].

What are the basics of using Dote?

You can browse our website and download our application (“Dote App”) from Apple App Store and browse the contents in the Dote App. But you are required to sign up for an account, and select a user name (“Dote User ID”) in order to shop on our Services. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your Dote User ID a name that you don’t have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.

You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian’s permission to use the Services and gotten your parent or guardian to agree to these Terms on your behalf).

You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Services is prohibited by applicable laws, then you aren’t authorized to use the Services. We can’t and won’t be responsible for your using the Services in a way that breaks the law.

You will not share your account with anyone, and you must protect the security of your account. You’re responsible for any activity associated with your account.

Your use of the Services is subject to the following additional restrictions:

You represent, warrant, and agree that you will not contribute any Content or User Submission (each of those terms is defined below) or otherwise use the Services or interact with the Services in a manner that:

  1. Infringes or violates the intellectual property rights or any other rights of anyone else (including Dote);
  2. Violates any law or regulation, including any applicable export control laws;
  3. Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
  4. Jeopardizes the security of your Dote account or anyone else’s (such as allowing someone else to log in to the Services as you);
  5. Attempts, in any manner, to obtain the password, account, or other security information from any other user;
  6. Violates the security of any computer network, or cracks any passwords or security encryption codes;
  7. Runs Maillist, Listserv, any form of auto-responder or “spam”, on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);
  8. “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means);
  9. Copies or stores any significant portion of the Content;
  10. Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services;
  11. Accesses, uses, or otherwise exploits the Services in violation of any applicable agreements, guidelines, regulations, or policies that Dote makes available on the Services or otherwise in any manner deemed objectionable by Dote in its sole discretion.

A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

What are my rights in Dote?

The materials displayed or performed or available on or through the Services, including, but not limited to, marks, logos, brand names, text, graphics, data, articles, photos, images, illustrations, User Submissions, and so forth (all of the foregoing, the “Content”) are protected by copyright and/or other intellectual property laws. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services, and you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you, (i) without the prior consent of the owner of that Content or (ii) in a way that violates someone else’s (including Dote’s) rights.

You understand that Dote owns the Services. You won’t modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, or otherwise exploit any of the Services.

The Services may allow you to copy or download certain Content; please remember that just because this functionality exists, doesn’t mean that all the restrictions above don’t apply – they do!

Do I have to grant any licenses to Dote or to other users?

User Submission means (1) any information, content, data or anything else that you post upload, share, store, or otherwise provide to your Dote account or otherwise on or through the Services, including any such information, content or data that is not viewable by any other user except you; and (2) any feedback, suggestions, improvements, enhancements, and/or feature requests relating to the Services you provide us (in a direct email or otherwise).

For all User Submissions, you hereby grant Dote a license to perform, display, distribute, translate, modify (for technical purposes, for example making sure your content is viewable on an iPhone as well as a computer), create derivative works of, reproduce, act with respect to, use and otherwise fully exploit your User Submissions, to enable us to operate the Services, or otherwise in connection with Dote’s business, provided that our use of any User Submission that constitutes Personal Information shall be treated in accordance with our Privacy Policy. This is a license only – your ownership in User Submissions is not affected.

You agree that the licenses you grant are royalty-free, perpetual, sublicenseable, irrevocable, and worldwide.

Who is responsible for what I see and do on the Services?

We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services. You are responsible for all Content you contribute, in any manner, to the Services, and you represent and warrant you have all rights necessary to do so, in the manner in which you contribute it. You will keep all your registration information accurate and current. You are responsible for all your activity in connection with the Services.

The Services may contain links or connections to third party websites or services that are not owned or controlled by Dote. When you access third party websites or use third party services, you accept that there are risks in doing so, and that Dote is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third party website or service that you visit or utilize.

Dote acts as an intermediary for users to interact with retailers available on the Services to buy and sell items offered by such retailers on the Services, and does not act as the buyer or seller (or agent for buyers or sellers) with respect to any such transactions. Dote has no control over, does not endorse or guarantee, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, Dote will not and cannot monitor, verify, censor or edit the content of any third party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third party website or service.

Your orders placed on the Services will be directly with the retailer offering the products. Your card is authorized when you place the order (before the retailer confirms the order) and is charged when the order is shipped from the retailer. You will see “Dote Shopping” as the merchant on your credit card bills. We’ll assist in the delivery of goods and refund processing, but your other interactions with the retailers, including pricing, or return of goods or services, return or refund policies, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such retailers. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties retailers. You agree that Dote shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. However, we always endeavor to provide our assistance to you to solve any issues you may encounter in the dealings with the retailers. Please refer to our FAQ webpage for additional information that applies to purchases made through the Services. If there is a dispute between you and a retailer shopped from on this site, or between you and any third party, you agree that Dote is under no obligation to become involved. In the event that you have a dispute with one or more other retailers or third parties, you release Dote, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her must have materially affected his or her settlement with the debtor."

What do I need to know about the Dote Credit Program?

Through the Dote Credit Program, Dote endeavors to reward and thank loyal customers for using, supporting, recommending and referring our business. Please refer to the app for more details about the Dote Credit Program.

Dote may, but has no obligation, to grant you any Credit free of charge. “Credit” means any credit, value, or the like granted to you by Dote in connection with Dote Credit Program. Credits may only be valid for a limited period of time, so please take note of any applicable expiration dates, and use your Credits in a timely manner. A Credit is not cash or a cash equivalent and cannot be redeemed for cash or cash equivalents. You may not transfer your Credits to another individual unless otherwise required by applicable laws. All Credits expire 3 months after the date they are granted.

Dote reserves the right to change, modify and/or eliminate the Credits and the terms applicable thereto at any time upon notice to you (which may be provided through the Services or by modifying these Terms). Dote reserves the right to terminate your participation in the Dote Credit Program if Dote determines in its sole discretion that you have violated these terms or that the use of your Dote account is unauthorized, deceptive, fraudulent or otherwise unlawful.

Will Dote ever change the Services?

We’re always trying to improve the Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We’ll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn’t always practical. Similarly, we reserve the right to remove any Content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice.

Does Dote cost anything?

Your access and use of the Services are currently free, but if you choose to purchase goods or services through the Services, you will be charged the listed price for such good or service, to the credit card or other payment method you provide in your Dote account (including, e.g. PayPal, Visa, Mastercard). Depending on the availability of the products, Dote may limit or cancel quantities of product purchased, and it reserves the right to refuse or cancel any order in its discretion. In the event Dote needs to make a change to an order, it will attempt to notify you by contacting the email address, billing address, and/or phone number provided in your Dote account or at the time the order was made. The prices displayed on our Services are quoted in U.S. currency. Prices are subject to change at any time. Sales tax will be determined by Dote and automatically be added to the order. If you provide inaccurate or incomplete credit card information, we may not be able to complete your transaction, and your purchase may be cancelled or delayed.

We reserve the right to charge for certain or all Services in the future. We will notify you before any Services you are then using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees for such Services.

What if I want to stop using my Dote account?

You’re free to cancel your Dote account at any time, by contacting us at [email protected]; please refer to our Privacy Policy as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services. You understand and agree that you will not be able to access your accumulated Points after you cancel your Dote account. All of the foregoing is subject to the restrictions and limitations set forth herein with respect to the Dote Credit Program.

Dote is also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms or other acts that deemed objectionable by Dote in its sole discretion. Dote has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.

Account termination may result in destruction of any Content associated with your account, including any accumulated Points, and it may not be possible to reinstate your Dote account once it is terminated, so keep that in mind before you decide to terminate your account. If you have deleted your account by mistake, contact us immediately at [email protected] – we will try to help, but unfortunately, we can’t promise that we can recover or restore anything.

Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.

I use the Dote App available via the Apple App Store – should I know anything about that?

These Terms apply to your use of all the Services, including the iPhone, iPad Touch, and iPad applications available via the Apple, Inc. (“Apple”) App Store (the “Application”), but the following additional terms also apply to the Application:

  1. Both you and Dote acknowledge that the Terms are concluded between you and Dote only, and not with Apple, and that Apple is not responsible for the Application or the Content;
  2. The Application is licensed to you on a limited, non-exclusive, non-transferrable, non-sublicensable basis, solely to be used in connection with the Services for your private, personal, non-commercial use, subject to all the terms and conditions of these Terms as they are applicable to the Services;
  3. You will only use the Application in connection with an Apple device that you own or control;
  4. You acknowledge and agree that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application;
  5. In the event of any failure of the Application to conform to any applicable warranty, including those implied by law, you may notify Apple of such failure; upon notification, Apple’s sole warranty obligation to you will be to refund to you the purchase price, if any, of the Application;
  6. You acknowledge and agree that Dote, and not Apple, is responsible for addressing any claims you or any third party may have in relation to the Application;
  7. You acknowledge and agree that, in the event of any third party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Dote, and not Apple, will be responsible for the investigation, defense, settlement and discharge of any such infringement claim;
  8. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
  9. Both you and Dote acknowledge and agree that, in your use of the Application, you will comply with any applicable third party terms of agreement which may affect or be affected by such use; and
  10. Both you and Dote acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as the third party beneficiary hereof.
What else do I need to know?

Warranty Disclaimer. Neither Dote nor its licensors or suppliers makes any representations or warranties concerning any content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through the Services. Products and services purchased or offered (whether or not following such recommendations and suggestions) through the Services are provided “AS IS” and without any warranty of any kind from Dote or others (unless, with respect to such others only, provided expressly and unambiguously in writing by a designated third party for a specific product). THE SERVICES AND CONTENT ARE PROVIDED BY DOTE (AND ITS LICENSORS AND SUPPLIERS) ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Limitation of Liability. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL DOTE (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO DOTE IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.

Indemnity. To the fullest extent allowed by applicable law, you agree to indemnify and hold Dote, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms.

Assignment. You may not assign, delegate or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without Dote’s prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.

Choice of Law; Arbitration. These Terms are governed by and will be construed under the laws of the State of California, without regard to the conflicts of laws provisions thereof. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in San Francisco County, California, in English, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. For all purposes of this Agreement, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in, respectively, San Francisco County, California, or the Northern District of California.

Miscellaneous. You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that the Dote may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and Dote agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Dote, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Dote, and you do not have any authority of any kind to bind Dote in any respect whatsoever. Except as expressly set forth in the section above regarding the Apple Application, you and Dote agree there are no third party beneficiaries intended under these Terms.

Please read the following to learn more about our Privacy Policy.By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.
Remember that your use of Dote’s Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and allow other users or our partners to contact you, to notify you of any changes to the Services or any promotions and events, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

Will Dote ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the website http://www.doteshopping.com, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.

What Information does Dote Collect?

Information You Provide to Us:
We receive and store any information you knowingly provide to us. For example, through the registration process, when you use the Services to make purchases, and/or through your account settings, we may collect Personal Information such as your name, email address, phone number, mailing address, payment and billing information. If you provide your third-party account credentials to us or otherwise sign in to the Services through a third party site or service, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. Certain information may be required to register with us or to take advantage of some of our features.

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we and/or Dote partners may send you promotional email offers, or email you about your use of the Services. Additionally, purchases trigger an automatic opt-in to 3rd party email marketing unless opted-out. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us, please indicate your preference by emailing [email protected] and indicating which communications you would like to opt out of. But please note that if you opt-out, you may not be able to take advantage of some of our features.

Information Collected Automatically
Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features. We may use third party service providers to collect data and information from and about you when you use our Services.

These third party service providers including our analytics partners may also transmit cookies (and/or other anonymous identifiers) to your browser or device, in order to collect information about your activities when you use the Services. Also, the Services may contain links or connections to third party websites or services, so if you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

Will Dote Share Any of the Personal Information it Receives?

We may share your Personal Information with third parties as described in this section:
Information that’s been de-identified. We may de-identify your Personal Information so that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience or improve their services to you. However, we never disclose aggregate usage or de-identified information to a partner (or allow a partner to collect such information) in a manner that would identify you as an individual person.

Specifically, Dote uses third party services to collect, store, and process information regarding your activities while you are using our Services in order to track, understand, and improve your user experiences with our Services. We may share your non-personal information with such third party service provider, which consists of technical information and aggregated usage information, and may contain, among other things: (i) your type and version of operation system; (ii) your usage length; (iii) your phone model; (iv) your country; (v) screens you visited in Dote’s mobile application; (vi) your touch gestures performed in Dote’s mobile application; (vii) your scrolling activity; (viii) your test; and (ix) any other actions you performed during your use of Dote’s mobile application. We will not share your information in a manner that would identify you as an individual person without your consent.

Brand Partners. In connection with the Services, Dote partners with many retail brands (“Brand Partners”). We will share certain information relating to your orders (such as your name and shipping address) with our Brand Partners so that they can fulfill your orders and provide you with customer support related to your orders. In some cases, we may also share other Personal Information, such as your e-mail address, with our Brand Partners, but only if you consent to such sharing by opting in during the registration process or turn on the relevant setting in your Dote account. During the consent process, you will be able to select the Brand Partners that you want to share your information with and those Brand Partners may use your information to directly promote and market their products and services to you. Our Brand Partners may also access and use your usage information in an aggregate and de-identified form to understand how often and in what ways you use our Services so that they can improve their provision of products and services to you.

Affiliated Businesses: In certain situations, businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit Third Party Account Information to your Services profile or to automatically transmit information in your Services profile to your third party account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you and/or to us; for example, we use a payment processing company to receive and process your credit card transactions for us, or we may use a third party service to gather and analyze aggregate data so that we can understand how our Services are being used. In some cases, our Brand Partners may act as Dote’s agents when performing tasks on our behalf to provide products or services to you. Also, we may use third party service providers to collect and process information about you. These agents may use your information, for example, to assist us, to provide their services to you and/or us, and to provide you with a relevant, targeted online experience. User Profiles and Submissions: Certain user profile information, including your name, email and other content that you have provided to the Services, may be used to address your request for our services. Your username and email may also be displayed when you send a message to us through the Services. Please remember that any content along with any Personal Information or content that you voluntarily disclose online or through the Services in a manner others can view becomes publicly available, and can be collected and used by anyone.

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of Dote and Others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Dote, our employees, our users, or others.

Is Personal Information about me secure?

Your information is protected on our servers (or third party servers in some cases) and by the security setting on your phone or other devices. If you access your account via a third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by limiting access to your computer or device and browser and protecting your other sign-on mechanisms.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

Dote currently only provide Services to users located in the United States.

What choices do I have?

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may request deletion of your account by emailing us at [email protected]. Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. These rules apply to any sweepstakes sponsored by Dote, Inc. ("Sponsor") with a Sweepstakes Page that link to these rules (each, a "Sweepstakes"). Each such Sweepstakes is a separate sweepstakes. A "Sweepstakes Page" is a page hosted by a Dote creator in the Dote App where you can access and view the detailed information of a Sweepstakes, including but not limited to, the end date of such Sweepstakes, the number, nature, and value of the prize, and the methods to enter into such Sweepstakes, and where you can participate in such Sweepstakes.

Eligibility

Subject to these Official Rules, each Sweepstakes is open only to permanent legal U.S. residents physically residing in the fifty (50) United States of America and the District of Columbia, who are at least 18 years old as of the date of entry. Employees of Sponsor, entity/entities associated with prize(s) identified on the Sweepstakes Page, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies and any other entity involved in the development or administration of such Sweepstakes, and their immediate family members or household members are not eligible to participate in or win such Sweepstakes. A SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH BELOW WOULD BE DEEMED CONSIDERATION. Entry Period

A Sweepstakes begins at the start time and ends at the end time as set forth on the Sweepstakes Page ("Entry Period").

How To Enter

No purchase or payment is necessary to participate in any Sweepstakes.

During the Entry Period (unless otherwise explicitly stated herein or on the Sweepstakes Page) for each Sweepstakes, you must do some of the following steps as explicitly stated on the Sweepstakes Page, for a submission to be considered official:

  • "Add Items to Favorites List" step: Add the number of unique items to any of your favorites lists as required by the Sweepstakes Page.
  • "Connect Instagram" step: Follow the steps in Dote's App to sign into your Instagram account.
  • "Create New Favorites Lists" step: Make the number of new favorites lists in your Dote account as required by the Sweepstakes Page.
  • "Follow Users" step: Follows the number of the unique Dote users that you currently aren't following or follow a specific user or users as required by the Sweepstakes Page.
  • "Get New Followers" step: Get the number of unique users to follow your account as required by the Sweepstakes Page.
  • "View Creator's New Content" step: View a host creator's Q&A; video, Youtube video, or/and Instagram post in the Dote's App as required by the Sweepstakes Page.
  • "Complete Creator's Quiz" step: Complete a host creator's quiz in the Dote's App as required by the Sweepstakes Page.
  • "Complete Sessions" step: Complete the number of unique sessions in the Dote's App as required by the Sweepstakes Page. A unique session is completed after you exit the Dote's App and enter again. If and as noted on the Sweepstakes Page, this step is measured over the time after you registered as a Dote's user until the end of the Entry Period.
  • "Visit Dote X Days in a Row" step: Visit the Dote's App every day in a row for the number of days as required by the Sweepstakes Page.
  • "Share Creator Profile" step: Share a host creator's profile with anyone from your contact list, either by clicking the step from the Sweepstakes Page and selecting a person from your contact list or using the "share" button from the host creator's profile, as required by the Sweepstakes Page.
  • "Invite Friends" step: Share Dote with the number of persons in your contact list as required by the Sweepstakes Page, either by clicking the step from the Sweepstakes Page and selecting a person from your contact list or using the "share" button on the Sweepstakes Page.
You shall comply with all applicable laws in connection with the email/text invitations and the way you send out your invitations. Sponsor and its agents will not be responsible for your acts or omissions.

In order for an entry to be considered eligible, you must have your full name and email on your profile in the Dote App. By submitting an entry, you agree that any information provided by you or collected by Sponsor in connection with a Sweepstakes may be used by Sponsor in accordance with Sponsor's Privacy Policy (https://www.doteshopping.com/legal) and may be shared with Sponsor's affiliated business entities. All information submitted to Sponsor as part of an entry becomes the property of the Sponsor.

Sponsor expressly reserves the right to disqualify any entries that it believes in good faith are generated by an automated means. Entries generated automated means are void.

Alternative Method of Entry ("AMOE")

You may also enter any Sweepstakes by mail as follows. On a plain 3" x 5" index card, legibly handprint or type your first name, last name, date of birth, complete address, city, state, zip code, home phone number (including area code), and email address (if any) and mail your completed 3" x 5" card to Dote: 515 Alabama St, San Francisco, CA 94110. To be considered eligible in a Sweepstakes, AMOE entries must be postmarked no later than the last day of the Entry Period. Each AMOE card received will be considered as one (1) entry for that entrant.

Regardless of the method used to enter a Sweepstakes, the maximum number of entries allowed during the Entry Period is one per entrant.

Prizes

One winner will be selected in accordance with these Rules to receive the prize(s) as set forth on the applicable Sweepstakes Page.

Decisions of the Sponsor are final and binding with respect to all matters related to each Sweepstakes. In no event shall the Sponsor be obligated to award any prizes other than the Prizes specified in these Official Rules. The Prizes are non-transferable and no substitutions (including, without limitation, for cash) are permitted, except that Sponsor reserves the right to substitute a prize of equal or greater monetary value for any Prize if such Prize should become unavailable for any reason. Winners shall be responsible and liable for all federal, state and local taxes on the value of the Prizes, and any related shipping and handling charges. To receive a complete list of winners or a copy of the Official Rules, within six (6) months after the end of the Entry Period, send a self-addressed stamped envelope to Dote Sweepstakes Winner's List, 515 Alabama St, San Francisco, CA 94110.

Please allow 6-8 weeks for delivery of Prizes. Dote shall be solely responsible for Prize fulfillment.

Winner Selection

The winning entry for the Prize will be chosen at random from all eligible entries during the Entry Period. The number of eligible entries received determines the odds of winning. In the event of a dispute regarding the identity of the potential winner, the potential winner will be deemed to be the person in whose name the Dote account is registered.

Each Sweepstakes will be conducted under the supervision of the Sponsor. The decisions of the Sponsor are final and binding in all matters relating to each Sweepstakes. Winners will be notified by email; provided, however, that Sponsor reserves the right to determine an alternate method of notification. Winners must claim their Prize within 10 days after the date of notification of such Prize. A Sweepstakes winner's failure to respond to the Prize notification within the specified 10-day period will be considered such Sweepstakes winner's forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

General Conditions And Releases

By entering a Sweepstakes or accepting a Prize, you agree to conform to all federal, state and local laws and regulations. When applicable, the winner may be required to execute and return (and winning may be conditioned upon the winner executing and returning) to Sponsor, within ten (10) business days, an Affidavit of Eligibility and a Liability and Publicity Release drafted by Sponsor to be eligible for the Prize or an alternate winner will be selected. Winners may be required in Sponsor's sole discretion to complete relevant tax forms as a condition to the delivery of the applicable prize. Winner may also be required to furnish proof of identity, address and birth date in order to receive a Prize.

Unless prohibited by applicable law, your acceptance of a Prize constitutes your permission to use your name, photograph, likeness, voice, address (city and state) and testimonials in all media, in perpetuity, in any manner Sponsor deems appropriate for publicity purposes without any compensation to such entrant or any review or approval rights, notifications, or permissions; and constitutes your consent to disclose your personally identifiable information to third parties (including, without limitation, placing the winner's name on a winner's list).

An entrant or winner may be disqualified from a Sweepstakes if he or she fails to comply with each provision of these Official Rules, as determined in the sole discretion of the Sponsor. Participation in a Sweepstakes is at entrant's own risk. Sponsor shall not be liable for: (1) failed, returned or misdirected notifications based on inaccurate information provided by the winner in connection with an entry; (2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, postage-due, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind; (3) any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in a Sweepstakes; (4) any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from downloading any application or otherwise in connection with each Sweepstakes; or (5) any warranty with respect to any Prize or any component thereof. THE PRIZES ARE AWARDED "AS IS" AND SPONSOR DOES NOT MAKE ANY, AND HEREBY DISCLAIMS ANY AND ALL, REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES.

NOTWITHSTANDING ANYTHING ELSE HEREIN OR OTHERWISE, SPONSOR AND/OR ITS VENDORS SHALL NOT BE LIABLE OR OBLIGATED WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR (A) ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, GOODWILL, OR ANTICIPATED PROFITS), (B) DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, AND/OR (C) ANY MATTER BEYOND SUCH PARTIES' REASONABLE CONTROL.

By entering a Sweepstakes, you agree to and hereby do release and hold harmless Sponsor, any other entity(ies) associated with Prize, and their respective parents, subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, "Claims") that may arise from your acceptance, possession and/or use of any Prize or your participation in the applicable Sweepstakes, or from any misuse or malfunction of any Prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. Any person attempting to defraud or in any way tamper with a Sweepstakes may be prosecuted to the full extent of the law. Sponsor reserves the right to modify these Official Rules in any way or at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend a Sweepstakes should viruses, bugs or other causes beyond their control corrupt the administration, security or proper operation of such Sweepstakes. In the event of cancellation or suspension, Sponsor shall promptly post a notice on Sponsor's website to such effect. Each Sweepstakes shall be governed by the state law of California, without regard to conflicts of laws provisions. By participating in a Sweepstakes, you agree that any dispute or litigation arising from or relating to such Sweepstakes shall be determined by binding arbitration only in San Francisco, California, by and under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, Sponsor may seek equitable relief in any court of competent jurisdiction. If any provision of these rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these rules otherwise remain in full force and effect and enforceable.
